1. About these terms
These terms apply to our website, quote form and related online facilities. "RegulaBuild", "we", "us" and "our" mean RegulaBuild Compliance Ltd. "You" means a visitor, enquirer or client, as applicable.
Please read these terms before using the website. If you do not agree, do not use it. Terms for paid services in sections 13 to 24 apply once you accept a written quotation from us, as explained in section 13; browsing the website or requesting a quote or an estimate does not create a paid-service contract.
2. Our role
We arrange and coordinate building-compliance services and related project administration. Technical assessments, calculations, testing, inspections and certification are undertaken or issued by appropriately competent professionals and, where required, registered or accredited providers. RegulaBuild is not a statutory building-control authority or Registered Building Control Approver. Using this website does not appoint us as a designer, engineer, surveyor, principal designer, principal contractor or other statutory dutyholder.
3. Information and news
Website content, Building Regulations news summaries, FAQs and automated chat responses provide general information. They are not project-specific technical, structural or legal advice. Requirements vary with the property, location, work and date. Obtain a written project assessment before acting. We take reasonable care with published information but news and guidance may be superseded. This does not override binding statements or information that the law makes part of your contract.
4. Outcomes
No website statement promises a test pass, regulatory approval, particular rating, planning permission, regularisation or certificate. Outcomes depend on the agreed scope, property conditions, evidence and decisions of the authorised professional or relevant authority. We remain responsible for fulfilling the obligations we agree to undertake.
5. Acceptable use
Use the website only lawfully. Do not attempt unauthorised access, bypass security or access restrictions, introduce malicious code, interfere with systems, impersonate anyone, harvest personal data, submit misleading information or upload unlawful or infringing content. Do not conduct vulnerability testing without our written permission. We may restrict access where reasonably necessary to address misuse, security threats or legal requirements.
6. Intellectual property
Unless otherwise identified, our branding, website text, design and original materials belong to us or our licensors. You may view, download and print reasonable copies for your own use in evaluating our services. Commercial republication, systematic copying or use of our branding requires written permission. Do not remove ownership notices. Your uploaded materials remain yours or their original owner's; section 11 explains the limited permission needed to handle them.
7. Links and automated assistance
External websites have their own terms and privacy practices. A link does not imply endorsement; we do not control external content or availability. If automated chat is available, it supplies general assistance and may make errors. Do not submit confidential project files, passwords, payment details or sensitive personal information in chat. Contact us for a human response or a written quotation. External-site and chat limitations do not remove responsibility for our contracted services.
8. Availability and changes
We take reasonable steps to maintain the website and quote form but access may be interrupted for maintenance, technical problems or security measures. We will seek to minimise disruption. Keep your own copies of important documents and contact us if a time-critical upload cannot be completed. We may update these terms for future use and show the revised date. Changes do not retrospectively alter an accepted service contract without agreement or lawful grounds.
10. Using the quote form
Provide accurate details and send only project information you are authorised to share. We do not currently offer client accounts; if we introduce them, these terms will be updated before they are used. Tell us promptly if your contact details or your authority to act for a client change.
11. Uploads, storage and document use
Our quote form accepts PDF, drawing (DWG, DXF), image (JPG, PNG, HEIC), Word and Excel files, up to 10 files of 20 MB each. Contact us before sending other formats or larger files.
You must own uploaded material or have permission to share it. Upload only information reasonably required for the project. Do not upload malware, unlawful content, unrelated personal information, identity documents or sensitive personal data unless specifically requested through an appropriate method. Identify document titles, dates and revisions clearly and check that each upload succeeds.
You give us permission to store, copy and share submitted material only as reasonably necessary to assess your enquiry, deliver the agreed services, administer the project, fulfil legal duties and protect legal rights. This permission does not transfer ownership. Uploading a document does not mean it has been reviewed, accepted as complete or approved. A deliverable is final only when identified as final or formally issued. Retain original copies and do not rely on us as your sole archive.
12. Records, closure and deletion
We may keep upload, download and administrative records for security and dispute handling where supported by the system, as explained in our Privacy Policy. We use reasonable and appropriate measures to protect information; no online system is completely risk-free.
Following project completion, files may be archived. We normally retain necessary project and contractual records for six years after completion, with a longer period where required for legal duties, regulatory records, safety or legal claims. Unnecessary information is removed sooner.
You may request access, correction or deletion by email. We assess requests under data-protection law and normally respond within one calendar month, subject to lawful extensions. We will explain any lawful reason for retaining information. Providers with their own statutory or professional duties may separately retain relevant records under their privacy notices.
13. Formation of a service contract
An enquiry, our automatic receipt email or an initial estimate is not an accepted instruction. Following your enquiry, we confirm the scope, deliverables and price in writing. Where further information is needed, we may provide an initial estimate before issuing a written quotation; an initial estimate is approximate and is not the agreed price. Your contract consists of the quotation, the agreed scope, these client-service terms and any additional terms expressly supplied and agreed before acceptance. It begins when you accept the quotation and we receive any payment the quotation requires before work starts, and we will confirm this in a form you can retain. If we cannot accept an instruction, we will return payments for services not supplied. Project-specific terms take priority only to the extent clearly agreed and permitted by law.
14. Delivery and professional appointments
We will supply the services we agree to undertake with reasonable care and skill. We may use qualified third-party providers to deliver technical work. Their professional opinions and statutory decisions remain their own. Subcontracting does not remove our responsibility for performance of our contract with you.
If a service instead requires a separate direct appointment between you and a professional or building-control body, we will make that arrangement and its scope clear before you commit. Any additional provider terms will be supplied beforehand. Provider identities will be disclosed where required for appointments, reports, certificates, statutory records or the proper administration of your project.
Building Regulations and CDM 2015 Principal Designer roles are separate. Where we provide Principal Designer services, your written quotation confirms which role is included, the scope and the formal appointment arrangements.
15. Scope and limitations
Only work and deliverables expressly included in the agreed scope are included in the price. Unless expressly included, the services do not comprise planning applications, party-wall advice, title investigations, intrusive investigations, opening-up works, remedial construction, continuous site supervision or a complete survey of the property.
Assessments and reports relate to the stated property, purpose, scope and conditions at the relevant time. Hidden, inaccessible or subsequently altered work may require further assessment. A test, inspection or certificate is not a guarantee of all aspects of a building. Statutory building-control decisions must follow the applicable lawful route. Higher-risk building services require an expressly agreed scope and the appropriate regulatory process.
16. Your responsibilities
Provide accurate, complete and timely project information, disclose material changes and confirm authority to instruct work and share documents. Arrange required dutyholder appointments and approvals, with our assistance only where included in scope. Provide safe and lawful access, necessary attendance and agreed site or test conditions. Read deliverable limitations and tell us promptly about apparent errors. Do not alter or misrepresent a report or certificate. These duties do not excuse a failure by us or our subcontractors to exercise the reasonable care and skill required by our contract.
17. Fees and payment
Your quotation confirms the price or how it is calculated, the payment schedule and any expenses or third-party charges. Depending on the service, the payment schedule may be full payment in advance, a deposit or staged payments. Work and appointments are confirmed following acceptance and receipt of any required payment. Consumer prices will include applicable taxes and unavoidable charges known in advance; where a charge cannot reasonably be calculated, its basis will be explained. Unless otherwise agreed, invoices are payable within seven calendar days.
We will obtain your agreement before additional paid work or additional charges. A changed design, incomplete information, extra visit or retest may require a revised quotation. No additional payment is due solely because we decide to extend the scope without your agreement. We may suspend outstanding work after reasonable notice for an overdue undisputed payment, allowing a reasonable opportunity to resolve it. For business clients, statutory late-payment interest and recovery charges may apply where permitted by law.
18. Visits, delays and events outside our control
You must ensure the agreed access and site readiness. If a visit cannot proceed because of a matter within your control, any charge must reflect reasonable resulting costs and the terms disclosed before booking. Retests and return visits are additional services unless included. We will take reasonable steps to minimise wasted costs.
We will meet agreed contractual deadlines or, where no deadline is agreed, provide services within a reasonable time. Indicative dates are estimates. Tell us before acceptance if a particular deadline is essential. We will notify you of material delays and take reasonable steps to reduce their effects. Authority processing, unavailable access and events outside our reasonable control may affect timing; this does not excuse avoidable delay or remove your statutory remedies. If we cannot provide an agreed service, you will receive a refund for the part not provided, subject to your other legal rights.
19. Reports and certificates
Deliverables are intended for the named property, project, client, purpose and agreed recipients. They must not be used for a different project or represented as addressing matters outside their scope. Unless the agreed scope or applicable scheme permits it, reliance by another person requires written agreement from the relevant issuer. You may share deliverables with authorities and project participants for their intended purpose. Sharing does not itself create additional duties to recipients.
Copyright remains with us or the issuing owner. Subject to agreed payment terms, you receive permission to use deliverables for the stated project and purpose. This does not restrict any rights arising by law. Certificates are issued only when the relevant issuer's requirements are satisfied; payment alone does not entitle a project to a pass or approval.
20. Consumer right to cancel
If you are an individual acting wholly or mainly outside your trade, business, craft or profession and enter a service contract online, by telephone or away from our business premises, you normally have a statutory right to cancel within 14 days without giving a reason. The period ends 14 days after the day the contract is made.
To cancel, send a clear statement to info@regulabuild.co.uk or to our registered office before the cancellation period expires. You may use the form in section 22 or on our Cancellation Rights page but do not have to. We will reimburse payments due back to you without undue delay and no later than 14 days after being informed of your decision. We use the original payment method unless you expressly agree otherwise and will not charge a refund fee.
21. Starting during the cancellation period
We will start services during the statutory cancellation period only following your express request. If you then cancel, you pay only an amount proportionate to the services actually supplied before cancellation, calculated against the agreed total price, where the law permits. We will not charge merely for unperformed work or committed costs under this statutory right. No such charge applies where we failed to give the required cancellation information or you did not expressly request an early start.
The right to cancel is lost on full performance only if performance began following your express request and your acknowledgement that you would lose the right once the service was fully performed. Booking a visit or uploading files alone is not that request or acknowledgement.
22. Other cancellations and termination
Outside the statutory cancellation right, you may cancel by emailing us. Subject to your legal rights, you must pay for work properly supplied and reasonable, evidenced net losses directly resulting from cancellation, including unavoidable third-party costs disclosed before contracting. We will reduce these by costs saved or recovered and refund any excess payment. We will not charge twice for the same loss.
We may end or suspend a service for a material breach, unlawful instructions, unsafe conditions or serious abusive conduct. Where appropriate, we will explain the issue and give a reasonable opportunity to remedy it. If we end a service without fault by you, we will refund payments for services not supplied. Your statutory rights remain unaffected.

23. Responsibility and liability
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability which cannot legally be excluded or limited. Nothing removes a consumer's statutory rights, including the right to services performed with reasonable care and skill and applicable remedies such as repeat performance, a price reduction or compensation.
For consumers, we are responsible for loss or damage that is a foreseeable result of our breach of contract or failure to use reasonable care and skill. Loss is foreseeable if it is an obvious consequence or was contemplated when contracting. We are not responsible for business losses under a consumer contract.
For business clients only, and subject to the first paragraph, we exclude indirect or consequential loss and loss of profits, revenue, business opportunities or anticipated savings to the extent the exclusion is lawful and reasonable. No exclusion applies where prohibited by applicable law.
We are not responsible for a decision of an independent authority merely because it is unfavourable, or for loss caused solely by inaccurate information or unauthorised changes made by you, provided we have complied with our own obligations. This does not exclude responsibility for our breach or for subcontracted performance for which we are legally responsible.
24. Complaints and confidentiality
Email info@regulabuild.co.uk with your project reference, the issue and the outcome sought, or write to our registered office. We aim to acknowledge service complaints within five working days and provide a substantive response within 20 working days. If investigation takes longer, we will explain and keep you informed. Tell us if you need communication adjustments. Our Complaints Procedure sets out the full process.
For data-protection complaints, we will acknowledge receipt within 30 days, investigate without undue delay and communicate the outcome. You may also complain to the Information Commission, the UK regulator for data protection. If a service dispute remains unresolved, we will provide any alternative-dispute-resolution information required by law and state whether we are required or willing to participate.
We use confidential project information only for agreed services, legitimate administration, professional advice, protection of legal rights or required disclosures. Personal information is handled under our Privacy Policy. Disclosure required by law or an authorised regulator may be necessary.
25. General provisions
If a term is unenforceable, the remaining terms continue where legally possible. A delay in exercising a right does not waive it. No person has a right under the Contracts (Rights of Third Parties) Act 1999 to enforce these terms unless expressly agreed; this does not affect rights arising independently by law.
The laws of England and Wales govern these terms. Business disputes are subject to the courts of England and Wales. Consumers retain any mandatory protections and rights to bring proceedings in the courts applicable to where they live. Contact: info@regulabuild.co.uk.
