When you need it

Employers, and anyone in control of premises, including landlords, must assess the risk from legionella and control it. The duties come from health and safety law, and HSE’s Approved Code of Practice L8, with its technical guidance HSG274, sets out how to meet them.

For most rented homes the assessment is simple, and HSE says landlords can carry it out themselves if they are competent. Testing or sampling for legionella is not usually needed in domestic hot and cold water systems.

Larger or more complex systems, such as those with stored water, communal plant or more vulnerable occupants, need a fuller assessment. Where a risk cannot be prevented, a written control scheme sets out the checks, who does them and how often.

  • Details of the boiler, water heaters and any storage tanks

Questions

Do landlords need a legionella certificate?

The law asks for a risk assessment, not a certificate. HSE says most landlords can carry out a simple assessment themselves; an independent assessment gives you a written record of what was checked.

Will you take water samples?

Not usually for homes. HSE says sampling of domestic systems is only needed in very specific circumstances. Where it is justified, sampling is priced separately.

How often should it be reviewed?

The law does not set an annual or two-yearly review. Review it periodically and whenever something changes, such as new plumbing or a change in who lives or works there.
